Missing MovementAny person subject to this chapter whothrough neglect or design misses the movementof a ship, aircraft, or unit with which he isrequired in the course of duty to move shall bepunished as a court-martial may direct.Provisions of article 87 should be self-explanatory.However, note that the violator, to be found guilty, neednot have known the exact hour or even the exact date ofthe scheduled movement. If a person had knowledge ofonly the approximate date, the court may convict theabsentee on the charge of missing movement. Missingmovement is a serious offense in the Navy. It leaves theship shorthanded and requires someone else to do theabsentee’s work and stand the absentee’s watches.Art. 88. Contempt Toward OfficialsAny commissioned officer who usescontemptuous words against the President, theVice President, Congress, the Secretary ofD e f e n s e , t h e S e c r e t a r y o f a m i l i t a r ydepartment, the Secretary of the Treasury, orthe Governor or legislature of any State,Territory, Commonwealth, or possession inwhich he is on duty or present shall be punishedas a court-martial may direct.Art. 89. Disrespect Toward SuperiorCommissioned OfficerAny person subject to this chapter whobehaves with disrespect toward his superiorcommissioned officer shall be punished as acourt-martial may direct.A superior commissioned officer is a commissionedofficer that is superior in rank or command. Disrespectincludes insulting words, insolence, impertinence,undue familiarity or other rudeness, and failing tosalute.Art. 90. Assaulting or Willfully DisobeyingSuperior Commissioned OfficerAny person subject to this chapter who(1) strikes his superior commissionedofficer or lifts up any weapon or offers anyviolence against him while he is in theexecution of his office; or(2) willfully disobeys a lawful commandof his superior commissioned officer;shall be punished, if the offense is committed intime of war, by death or such other punishmentas a court-martial may direct, and if the offenseis committed at any other time, by suchpunishment, other than death, as a court-martialmay direct.An officer is in the “execution of his office” whenperforming any act the officer is required or authorizedto do. Note that the article is not confined to striking asuperior commissioned officer; it takes in brandishing aweapon or waving a fist at that officer.Willful disobedience, as used here, meansintentional defiance of a lawful order. You mustpresume that any order given by an officer is legal. If youdisobey because you think otherwise, you do so at yourown risk. It is better to do your questioning after youhave carried out the order.Art. 91.
